Cory Watson attorney Nina Towle Herring has been named to the Plaintiffs’ Steering Committee (PSC) for In Re: Elmiron (Pentosan Polysulfate Sodium) Products Liability Litigation; the multidistrict litigation involving Elmiron medication linked to serious eye damage.
Mrs. Herring is one of 25 attorneys appointed by U.S. District Judge Brian R. Martinotti. The PSC will continue to investigate and develop the Elmiron (Pentosan Polysulfate Sodium) claims. The committee also oversees the coordination, preparation, and presentation of the cases.
“It is a great honor to pursue this nationwide litigation alongside a highly talented, passionate group of attorneys,” said Herring. “We take seriously the opportunity to fight for justice on behalf of consumers who were harmed by this defective drug.”
The U.S. Judicial Panel on Multidistrict Litigation established MDL 2973 in December 2020, consolidating defective drug liability cases involving Elmiron in the United States District Court for the District of New Jersey. Over 130 cases have been transferred to the federal MDL, with hundreds more expected to be filed against the manufacturer of Elmiron.
Elmiron was approved by the FDA in 1996 for the treatment of painful bladder syndrome (interstitial cystitis). However, studies released in 2018 and 2019 showed a link between Elmiron (pentosan polysulfate sodium) and pigmentary maculopathy. The Elmiron label was changed in June 2020 to warn for retinal pigmentary changes. Symptoms of pigmentary maculopathy may include trouble reading, trouble adjusting to dim lighting, glare, blind spots, and in severe cases, blindness. The majority of plaintiffs represented in the MDL are anticipated to be women as interstitial cystitis, the medical condition that Elmiron was prescribed for, largely affects female patients.
“Despite Elmiron being an older drug, manufacturers always have a responsibility to fully investigate, and warn users about, serious side effects,” Herring said. “The manufacturers of Elmiron failed to do that and we will hold them accountable.”
