Johnson & Johnson Hit Again With A $110 Million Verdict

Another week, another verdict against Johnson & Johnson for its talc-based products and their link to ovarian cancer. This week a St. Louis, Missouri, jury awarded $110.5 million to a Virginia woman who sued Johnson & Johnson, along with its talc supplier Imerys Talc, claiming she developed ovarian cancer after decades-long use of the company’s talc-based products. This verdict results in the largest settlement to date against Johnson & Johnson for its Shower-to-Shower and Johnson’s Baby Powder products. Virginia resident Lois Slemp was diagnosed with ovarian cancer in 2012 and is currently undergoing chemotherapy. The cancer has already spread to her liver. Slemp testified that she developed ovarian cancer after using the company’s talc-based products—specifically Baby Power and Shower-to-Shower Powder—for the last 40 years. The jury awarded her $5.4 million in compensatory damages and $105 million against Johnson & Johnson for punitive damages, as well as $50,000 against Imerys Talc. The jury said they found Johnson & Johnson 99 percent at fault and Imerys Talc one percent at fault. In the past 18 months, there have been five talc product verdicts against Johnson & Johnson, awarding settlements of approximately $72 million, $70 million and $55 million. There are currently thousands of other cases awaiting trial. Johnson & Johnson has only won one court case on the topic. Its single victory was in March filed by a Tennessee woman who claimed to develop cancer after using the company’s baby powder.
