$671 Million Settlement of DuPont-Chemours Lawsuit Involving Toxic Chemical C-8

REACTION FROM PLAINTIFF CO-LEAD COUNSEL JON C. CONLIN OF CORY WATSON ATTORNEYS BIRMINGHAM, Ala. – DuPont and its affiliate company Chemours will pay $670.7 million in cash to settle approximately 3,550 lawsuits involving the toxic chemical C-8, which was used at a DuPont plant outside Parkersburg, WV. An independent Science Panel had linked C-8 to testicular cancer and kidney cancer as well as other diseases including ulcerative colitis, pregnancy-induced hypertension, thyroid disease, and high cholesterol. “We are extremely honored to have been able to assist the plaintiffs who had the courage to step up and pursue their cases, and we are proud of the legal team that worked to obtain the recent verdicts and this settlement,” said Cory Watson attorney Jon C. Conlin, who serves as Co-Lead Counsel for Plaintiffs in MDL-2433. “The plaintiffs in the communities who were exposed to C-8 for so many years will finally receive fair compensation.” The litigation, MDL 2433: In re: E. I. du Pont de Nemours and Company C-8 Personal Injury Litigation, had consolidated all federal C-8 cases in U.S. District Court in the Southern District of Ohio before the Hon. Edmund A. Sargus, Jr. The personal injury and wrongful death claims all stemmed from injuries reported in communities on the Ohio River near the Washington Works Plant outside Parkersburg, West Virginia. The Washington Works Plant was operated by DuPont and produced Teflon using the chemical perfluorooctanoic acid (PFOA), more commonly known as C-8. “These injured men and women took on a David versus Goliath battle against DuPont with no certainty of success,” said Conlin. “This settlement marks a huge step toward justice for a community of people who were unknowingly exposed to toxic chemicals for upwards of 50 years. Federal Panel Transfers Abilify MDL Litigation to Northern District of Florida

Popular Prescription Drug Linked to Compulsive Gambling WASHINGTON, D.C. – The United States Judicial Panel on Multi-district Litigation has issued a Transfer Order centralizing federal lawsuits in the Abilify® drug litigation, MDL No. 2734. These cases will be transferred to a federal court in the Northern District of Florida for the discovery stage of litigation. The Honorable M. Casey Rodgers was selected to preside over the multi-district litigation. Attorneys on both sides of the issue support the Transfer Order. In the October 3, 2016 Order, the Panel stated that on the basis of papers filed and a hearing session held: “All the actions share common factual questions arising out of allegations that Abilify (Aripiprazole), an atypical antipsychotic medication commonly prescribed to treat a variety of mental disorders, can cause impulse control problems in users. Plaintiffs in these actions each allege that they experienced compulsive gambling behaviors as a result of taking Abilify.” Furthermore, the Panel stated that “all the actions involve factual questions relating to whether Ability was defectively designed or manufactured, whether defendants knew or should have known of the alleged propensity of Abilify to cause compulsive gambling behaviors in users, and whether defendants provided adequate instructions and warnings with this product.” “We are glad the courts will consider this litigation and the tragic impact this widely prescribed drug has had on so many individuals and their families,” said Kristian Rasmussen of Cory Watson Attorneys, a law firm representing several thousand Abilify clients. Leila H. Watson Named to Leadership Birmingham 2017

Cory Watson Attorneys co-founder Leila H. Watson has been selected for the 2017 class of Leadership Birmingham. Ms. Watson also serves as President-Elect of the Birmingham Bar Association.  The purpose of Leadership Birmingham is to ensure that leaders in the community are educated about current issues and challenges in the region. This is accomplished by bringing together a group of 50 leaders each year from diverse backgrounds. Through a series of monthly programs, these leaders come to know and understand more about the community and one another as they explore issues and exchange ideas. Wrongful Death Lawsuit Filed Against Hooters in Underage Drinking Death of Teenager

BIRMINGHAM, Ala. – The family of a teenager who was struck and killed by a vehicle in front of the Pelham, Alabama Hooters Restaurant has filed a wrongful death lawsuit against Hooters, to hold the restaurant owners and operators accountable for the series of liquor law violations that led to the teen’s death. Ryan Rohr was struck by a vehicle and killed just moments after leaving the Pelham Hooters on Highway 119 with friends on May 25, 2016. According to the suit filed in Circuit Court in Shelby County, Alabama (Case Number 58- CV -2016-900703.00), servers at Hooters never asked Ryan to show an ID when he ordered alcohol, which he consumed with co-workers during a two to three-hour visit at the restaurant. The suit claims servers continued to provide him alcohol even after he became visibly intoxicated. Ryan, a resident of Bartow County, Georgia, had traveled to Alabama to work on a construction project and had been staying at a hotel across the street from Hooters. He was trying to return to the hotel when he was struck. According to the lawsuit, another minor in the group was also illegally served alcoholic beverages during the trip to Hooters. “This case highlights what happens when a company breaks the law and sells alcohol to a minor. In this case, when Hooters broke the law, a young man died,” said Cory Watson attorney Douglas A. Dellaccio, who represents Ryan’s parents, who filed the suit. Dellaccio says the medical examiner’s report revealed Ryan had a blood alcohol content of .24 at the time of his death, which is three times the legal limit for an adult. Any blood alcohol content above 0 is considered illegal for a minor. “Teenagers are especially vulnerable. Hooters knows that. Alabama law clearly holds establishments accountable for upholding the laws governing the sale and service of alcoholic beverages,” said Dellaccio. “Hooters broke the law by serving Ryan alcohol and by continuing to serve him alcohol, even after he passed the point of obvious intoxication. Ryan died as a result, and we are holding them accountable for his death. Those who sell and serve alcohol bear full responsibility for their actions.” The suit charges that as a “proximate result of the negligent, wanton, willful and/or wrongful conduct of the Defendants in serving alcoholic beverages to Ryan Joseph Rohr, who was under the age of 21 years, Ryan Joseph Rohr became grossly intoxicated and was killed.” The wrongful death suit seeks unspecified punitive damages from defendants Hooters of Pelham, LLC, and Hooters of America, LLC. A server at the restaurant is also named in the suit. The suit is brought under Alabama’s Dram Shop Laws and under the Civil Damages Act.
