$9 Million Record Verdict For Lee County, AL Medical Malpractice Case

BIRMINGHAM, Ala. – An Alabama jury has returned a $9 million verdict for the family of Hope Johnson in a wrongful death medical malpractice case that breaks records for Lee County. In December of 2014, Hope Johnson visited Auburn Urgent Care after experiencing sharp chest pains, difficulty breathing, and cough. She had been there just two days earlier with similar, but milder complaints. On that first visit, she was examined by the doctor, prescribed an antibiotic, and instructed to return if she got worse. When Hope returned to Auburn Urgent Care, her vital signs were at panic levels. However, it was the first day of work for a new physician at Auburn Urgent Care, and he had been instructed by the medical director to see patients without any access to the current or past medical records of any patient. Hope’s condition was critical, and an ambulance should have been called to take her to East Alabama Medical Center. Instead, she was sent home with an inhaler. Hope died the next day of blood clots in the lungs. Cory Watson Attorneys Leila Watson and Nina Herring, alongside Brett Turnbull of the Turnbull Law Firm, represented the Johnson family and secured the $9,000,000 verdict. “Hope’s death is tragic because it was entirely preventable. We don’t know the exact number of patients seen that day, but it was too many,” according to Turnbull. “Patient well-being, not profits, should be the primary goal of healthcare.” “This verdict represents the power of a jury,” adds Watson. “They will affect change by their vote here, by their verdict.” The verdict is the largest in a Lee County medical-malpractice case. The Johnson family released the following statement through their attorneys: “We are very pleased with the jury decision in the wrongful death case of our precious daughter Hope. We continue to feel her absence every day and pray this decision brings about much-needed change. Our chief desire is that this case will set a precedent that will prevent this from happening to another family or college student, not just in Lee County, but in Alabama as a whole.” The verdict was announced on October 11, 2019. The case is Estate of Hope Johnson vs. Auburn Urgent Care, Case Number 43-cv-900204. GM Recalls 3.5 Million Trucks and SUVs for Faulty Brake Problem

General Motors is recalling nearly 3.5 million pickup trucks and SUVs affected by faulty braking systems, according to the National Highway Traffic Safety Administration (NHTSA). The agency has reported more than 113 crashes and 13 known injuries linked to General Motors vehicles with defective brakes. This issue was first brought to light by the faulty brake attorneys at Cory Watson, who filed both a 2017 class action lawsuit in Texas and a 2018 class action lawsuit in California on behalf of clients who experienced collisions as a result of the GM brake defect. Which General Motors Vehicles Have Faulty Brakes? The nationwide recall involves some of GM’s best-selling vehicles, including: 2015 to 2017 Cadillac Escalade 2014 to 2018 Chevrolet Silverado 2015 to 2018 Chevrolet Suburban 2015 to 2018 Chevrolet Tahoe 2014 to 2018 GMC Sierra 2015 to 2018 GMC Yukon/Yukon XL The recall acknowledges a defect in the design of the vehicle’s vacuum brake assist pump. The flaw makes it difficult to stop with the brake pedal becoming hard, requiring the driver to use much more force to slow the vehicle, increasing stopping distance and the risk of a dangerous crash. “It’s a serious public safety threat, not only for those in GM vehicles with the faulty braking systems, but for all other drivers and passengers sharing the road with them,” said Cory Watson principal attorney Jerome Tapley. Cory Watson Defective Brake Attorneys Weigh In This recall confirms what the experienced brake failure lawyers at Cory Watson already knew, and what their clients have been alleging for nearly two years. “General Motors now admits it has installed faulty braking systems in millions of Chevrolet, Cadillac, and GMC trucks and SUVs for years, but it had never before informed consumers of the dangers,” said Cory Watson principal attorney Ryan Lutz. Cory Watson Attorneys are no stranger to winning large settlements against automotive giants. In 2017, a California state court jury awarded a $25 million verdict to our clients after determining that a Nissan SUV’s defective brakes caused an accident that killed three people and resulted in an elderly driver being wrongfully charged with vehicular manslaughter. Cory Watson attorneys Jerome Tapley, Ryan Lutz, and Adam W. Pittman led the trial team representing plaintiffs. “General Motors must be held accountable for the safety of the vehicles they make, and for the safety of the consumers who buy them,” said Cory Watson attorney Adam W. Pittman. Do You Have a Claim Against General Motors? It shouldn’t take 113 crashes and 13 known injuries to acknowledge a safety defect. With millions of affected GM pickups and SUVs on the roads, our attorneys know that it is only a matter of time until more people are hurt. Cory Watson Attorneys are leading the nationwide investigation into GM brake defect accidents and are actively filing claims on behalf of those injured by a GM vehicle with defective brakes. Cory Watson Attorneys Files Suit against Memphis Light, Gas and Water

Nashville office of personal injury law firm to fight for severely injured I-240 driver from Memphis MEMPHIS, Tenn. – A severely injured Memphis motorist has filed suit against Memphis Light, Gas and Water (MLGW) citing the company’s neglect and reckless care of a utility pole located in the median of I-240 as the cause of his hospitalization for severe brain injuries and head trauma. On the evening of May 8, 2019, 25-year-old Samuel Butler was traveling along Interstate 240 when his Chevrolet Camaro left the roadway in the wet conditions. As the vehicle spun out of control, an 80-foot-long, nearly 800-pound metal utility pole left on the median by MLGW impaled the car from the driver’s side window passing through the cockpit to the passenger side window – striking the driver in the head as it passed through the vehicle. Butler was seriously injured as a result, with life-threatening head injuries that caused bleeding on the brain. The 25-year-old was pinned in his seat while several Good Samaritans worked to free him from the car. He is now hospitalized and continues to receive critical medical care, including emergency brain surgery. At the time of this release, Butler remains in critical condition. Though he has been taken off the ventilator, the young man now faces a long road to recovery. “It’s troubling that no one has explained how or why this 800-pound pole was downed,” said lead plaintiff’s attorney, J. Curt Tanner of Cory Watson Attorneys. “This lawsuit sends a message that there are people willing to stand up and hold these utility companies accountable. Yes, they have a job to do, but they must keep our roads safe and clear of dangers for all drivers.” The lawsuit, filed by Butler and his mother, Artena Butler, charges that Memphis Light, Gas and Water “failed to maintain a safe and hazard-free roadway.” The suit also claims that the utility company “failed to exercise due care in its maintenance and control of the utility/light pole” and did not warn of an improperly placed pole on the interstate, “gravely endangering the lives and well-being of the public.” MLGW officials say they had no record of a pole being down at that location. “Whether the pole was downed by weather, a previous accident, or was there as a part of a construction project, the public expects MLGW to know the status of their equipment — particularly when it’s an 800-pound metal utility pole sitting in a median on one of the busiest roadways in Memphis,” said co-attorney Hamilton Jordan of Cory Watson Attorneys. The lawsuit is filed in the Circuit Court for Shelby County in the state of Tennessee. “Our goal is to get justice for Samuel and his family, and by bringing this to court, make sure that this preventable tragedy never happens again,” explained Tanner.
