Cory Watson Attorneys Files Suit against Memphis Light, Gas and Water

Nashville office of personal injury law firm to fight for severely injured I-240 driver from Memphis MEMPHIS, Tenn. – A severely injured Memphis motorist has filed suit against Memphis Light, Gas and Water (MLGW) citing the company’s neglect and reckless care of a utility pole located in the median of I-240 as the cause of his hospitalization for severe brain injuries and head trauma. On the evening of May 8, 2019, 25-year-old Samuel Butler was traveling along Interstate 240 when his Chevrolet Camaro left the roadway in the wet conditions. As the vehicle spun out of control, an 80-foot-long, nearly 800-pound metal utility pole left on the median by MLGW impaled the car from the driver’s side window passing through the cockpit to the passenger side window – striking the driver in the head as it passed through the vehicle. Butler was seriously injured as a result, with life-threatening head injuries that caused bleeding on the brain. The 25-year-old was pinned in his seat while several Good Samaritans worked to free him from the car. He is now hospitalized and continues to receive critical medical care, including emergency brain surgery. At the time of this release, Butler remains in critical condition. Though he has been taken off the ventilator, the young man now faces a long road to recovery. “It’s troubling that no one has explained how or why this 800-pound pole was downed,” said lead plaintiff’s attorney, J. Curt Tanner of Cory Watson Attorneys. “This lawsuit sends a message that there are people willing to stand up and hold these utility companies accountable. Yes, they have a job to do, but they must keep our roads safe and clear of dangers for all drivers.” The lawsuit, filed by Butler and his mother, Artena Butler, charges that Memphis Light, Gas and Water “failed to maintain a safe and hazard-free roadway.” The suit also claims that the utility company “failed to exercise due care in its maintenance and control of the utility/light pole” and did not warn of an improperly placed pole on the interstate, “gravely endangering the lives and well-being of the public.” MLGW officials say they had no record of a pole being down at that location. “Whether the pole was downed by weather, a previous accident, or was there as a part of a construction project, the public expects MLGW to know the status of their equipment — particularly when it’s an 800-pound metal utility pole sitting in a median on one of the busiest roadways in Memphis,” said co-attorney Hamilton Jordan of Cory Watson Attorneys. The lawsuit is filed in the Circuit Court for Shelby County in the state of Tennessee. “Our goal is to get justice for Samuel and his family, and by bringing this to court, make sure that this preventable tragedy never happens again,” explained Tanner. $25 Million Nissan Faulty Brake Verdict Upheld by California Supreme Court

The California Supreme Court has denied Nissan’s petition to appeal a $25 million verdict that Cory Watson Attorneys helped secure in a lawsuit blaming faulty brakes for a car crash that killed three people and caused a wrongful manslaughter charge. The case was originally tried in July 2017 in the Superior Court of California for Los Angeles County. The verdict was upheld on May 15, 2019. This decision affirms the appeals court’s previous findings and makes the judgment final. At time of publication, this is estimated to be the largest verdict against Nissan North America regarding the brake defect case, and potentially the fourth largest verdict ever against Nissan North America. TopVerdict has ranked the verdict at #5 on their list of the Top 10 car accident verdicts in California in 2017 and #15 on their list of the Top 20 verdicts in California in 2017. It is also ranked as #21 on the list of the top 50 plaintiff’s car accident jury verdicts obtained in the United States in 2017. “By appealing, Nissan unnecessarily stretched out the legal process for those families who have lost their loved ones in a preventable tragedy that never should have happened,” said principal Ryan Lutz of Cory Watson Attorneys. “Now, the family can rest in the knowledge that this case has reached its end.” The Los Angeles jury determined that the incident was 100 percent attributable to the braking system defect in the Infiniti QX56 SUV, and that Nissan was negligent in failing to recall the vehicle. “Our firm is willing to fight until the very end of the appeals process for our clients,” said principal F. Jerome Tapley of Cory Watson Attorneys. “The California Supreme Court confirmed what we already knew – that Nissan should be held accountable for dangerous products defects like faulty brakes.” The case is Cruz v. Nissan North America, Inc., et al., case number BC493949, in the Superior Court of California for Los Angeles County. “We hope this verdict inspires automotive manufacturers like Nissan to step up and take responsibility for the safety of their vehicles so that no one else is killed or injured because of a dangerous product defect they failed to reveal and recall,” said Adam W. Pittman of Cory Watson Attorneys. About Cory Watson Attorneys Cory Watson Attorneys is a nationally recognized personal injury law firm with offices in Birmingham, Alabama, and Nashville, Tennessee. Cory Watson $25 Million Verdict Against Nissan Upheld by Appeals Court

A California court upheld the $25 million verdict that Cory Watson Attorneys helped secure against Nissan in a lawsuit blaming faulty brakes for a car crash that killed three people. The case, Cruz v. Nissan North America, et al., was originally tried in the Superior Court of California for Los Angeles County. The jury’s verdict was affirmed on appeal on Wednesday, February 26. “This has been a long road for our clients, and as a firm, we take great pride in fighting for justice and helping bring closure to their grieving families,” said Cory Watson principal attorney Ryan Lutz. The plaintiffs – Hilario Cruz, Araceli Mendez, and Solomon Mathenge – were represented by F. Jerome Tapley, Brett Turnbull, Ryan Lutz, and Adam W. Pittman of Cory Watson Attorneys. Additional representation for the plaintiffs was provided by Paul Kiesel of Kiesel Law LLP, Kirk Wolden of Carter Wolden, as well as Claudia C. Bohorquez and Vicki I. Sarmiento. “Our firm is willing to fight until the very end of the appeals process for our clients,” said principal F. Jerome Tapley of Cory Watson Attorneys. “The appellate court confirmed what we already knew.” The case stems from a fatal 2012 crash caused by a critical failure in the braking system of a 2004 Infiniti QX56 SUV. When the Infiniti’s driver collided with a minivan in a Hollywood intersection, all three of the van’s occupants, a mother and her two young daughters, were killed in the impact. “Nissan acted with reckless disregard for the lives of others,” said principal attorney Brett Turnbull. “It’s only right that Nissan should be held accountable, as their vehicles are still on the road today.” The Los Angeles jury determined that the incident was 100 percent attributable to the braking system defect in the Nissan-made SUV, and that Nissan had been negligent in failing to recall the vehicle. “Our hope is that this verdict inspires auto manufacturers like Nissan to step up and take responsibility for the safety of their vehicles. No one should be injured by known product defects like the faulty brakes in this case that are so obviously dangerous,” said Cory Watson attorney Adam W. Pittman. Feds Investigating Johnson & Johnson Baby Powder Cancer Claims

The federal government is investigating Johnson & Johnson over concerns that the company’s talcum-based baby powder may contain asbestos. Johnson & Johnson disclosed that federal regulators were raising questions about the company’s talcum powder products in a filing with the Justice Department and the Securities and Exchange Commission (SEC). The federal investigation comes in the wake of a series of lawsuits involving baby powder, some decades in the making. Several high-profile judgments were awarded to plaintiffs who claimed the pharmaceutical company talc products caused their ovarian cancer and mesothelioma. The most recent suit was decided in July 2018: A jury in Missouri ordered Johnson & Johnson to pay up $4.7 billion to 22 women who claimed the company’s talcum-based baby powder caused their cases of ovarian cancer. These are the first federal investigations stemming from the issue. J&J Knew About Asbestos in Baby Powder The inquiries come two months after news reports revealed documents suggesting that the company knew about the risk of asbestos in its products. According to a Reuters investigation, Johnson & Johnson knew that its baby powder talc supply was tainted with carcinogenic asbestos as early as 1971. The report alleges that J&J kept their knowledge secret from consumers and regulators, failing to warn to warn consumers of the risks. Johnson & Johnson now faces lawsuits from thousands of people across the country, and it’s not too late to join them in the pursuit of justice.
