Johnson & Johnson and its subsidiary DePuy Orthopaedics have agreed to extend the deadline to file a claim regarding its faulty ASR hip implant devices, and will pay approximately $420 million to eligible plaintiffs.
According to a Bloomberg report published Feb. 23, the manufacturer estimates there are an additional 1,400 patients who received an ASR hip implant device after Aug. 31, 2013, which was the original deadline to file a claim for compensation.
Johnson & Johnson and DePuy have extended the deadline to include any person who had surgery to remove its ASR hip implant device after Aug. 31, 2013 and before Jan. 31, 2015. Official documents filed in a Toledo, Ohio federal court state that each plaintiff will receive approximately $300,000 for damages related to the flawed devices.

Johnson & Johnson conducted a recall on the hip implants in 2010, after numerous reports that the devices had failed after only five years. The manufacturer claimed the devices would last up to 20 years and would increase patients’ comfort and range of motion. In all, 93,000 ASR hip implant devices were recalled.
Following the recall, many patients began to experience symptoms of metal poisoning, and lawsuits were subsequently filed claiming the implants were designed defectively.
Plaintiffs allege that the metal ball and socket design of the hips cause chromium and cobalt ions to be deposited into a patient’s bloodstream, sickening them with toxic chemicals. These patients were then forced to have additional surgeries to remove the faulty devices.
