A Philadelphia jury awarded a $27.8 million verdict to the plaintiff in a lawsuit against Johnson & Johnson and Bayer AG, the manufacturers of the blood thinner Xarelto. The plaintiff suffered from severe gastrointestinal bleeding while on Xarelto. The jury found the drug manufacturers’ provided inadequate information and warnings about the risks and rates of bleeding associated with Xarelto.
WHAT IS XARELTO?
Xarelto is a blood thinner prescribed to reduce the risk of blood clots and stroke in patients with atrial fibrillation, treat deep vein thrombosis and pulmonary embolisms, and reduce the risk of blood clots in patients undergoing knee or hip replacement surgery.
Specifically, Xarelto’s manufacturers failed to properly warn patients and prescribing physicians about the higher risk of bleeds when using the Xarelto alongside aspirin. They also failed to inform doctors that some patients end up with significantly higher levels of Xarelto in their blood than others.
Further, clinical trials indicated that patients in the United States suffered severe adverse bleeding at a higher rate than patients globally. According to evidence in the case, the bleeding rate among participants in the United States was 8.1% annually versus 3.6% annually among participants globally.
