Alabama is a Dangerous Place for Pedestrians

Between 2005 and 2014, 724 Alabama pedestrians suffered traffic-related fatalities. This has led to Alabama being rated as the second most dangerous state for pedestrians in the country by SmartGrowthAmerica.org. The group reports that Alabama averages 1.5 pedestrian fatalities per 100,000 people per year.

Careless drivers are at fault for many of these deaths; but they are not necessarily the only cause.

Common Causes of Wrecks between Cars and Pedestrians

  • Negligent drivers: Driving too fast for conditions or distracted can cause a driver to fail to notice or react to a pedestrian on the road, drivers who are under the influence of drugs or alcohol which can affect a drivers ability to perceive and recognize pedestrians
  • Dangerous roadways: Narrow or curvy roads can reduce the ability to see pedestrians crossing the road. Rough roads with bad road surfaces can send vehicles out of control. Overgrown foliage can also block the vision of drivers and pedestrians.
  • The Elderly and the Very Young: Older individuals who may wander into a road because of dulled senses or confusion and children who dart out into traffic can be causes for pedestrian wrecks
  • Pedestrians: Walking near a road while distracted by phones, music, or other people can be a dangerous situation for pedestrians

Alabama’s Contributory Negligence Law

In Alabama, if the pedestrian contributed just one percent to the wreck they were injured because of are barred from recovering any money for their injuries. This is a common tactic employed by insurance companies to try and escape liability in pedestrian involved wrecks.
